Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is part of our Terms of Service and applies to everyone who accesses or uses elGoony (the “Service”), whether as a member, a creator, or a visitor.

1. Absolutely prohibited — zero tolerance

The following are strictly forbidden. Breach will lead to immediate and permanent account termination, forfeiture of wallet balance to the extent permitted by law, preservation of evidence, and reporting to the competent authorities and, where applicable, to specialised hotlines and to payment networks.

Any sexual content involving, depicting, or sexualising minors, or anyone who appears to be a minor (CSAM).
Any non-consensual content, including “revenge” content, hidden-camera recordings, deepfakes of real people without verifiable consent, blackmail and sextortion material.
Content depicting real-world sexual violence, trafficking, or coercion.
Content depicting bestiality, necrophilia, or content that glorifies, incites or instructs serious harm or terrorism.
Doxxing, threats, stalking, or harassment of any person.
Content of identifiable real people uploaded without verifiable, written consent of every identifiable person depicted.
Selling, advertising, or facilitating the sale of weapons, controlled drugs, stolen goods, fraudulent documents, or other illegal goods or services.
Use of the Service in or for the benefit of sanctioned jurisdictions or sanctioned persons.

2. Prohibited conduct

Creating an account if you are under 18 or not legally permitted to use the Service in your country.
Providing false age, identity, payment, or KYC information.
Sharing or selling your account, or letting anyone else use it.
Fraud, money laundering, terrorist financing, or any form of payment abuse, including knowingly using stolen payment instruments.
Initiating chargebacks for transactions you authorised, instead of contacting support first.
Re-distributing, re-uploading, downloading at scale, mirroring, or otherwise pirating creator content. Each subscription or unlock is for your personal, non-commercial use.
Scraping, crawling, mass-downloading, screen-recording for redistribution, reverse engineering, or any automated access not expressly authorised by us in writing.
Bots, fake accounts, click-farms, artificial engagement, manipulating discovery or rankings.
Circumventing rate limits, paywalls, geo-blocks, the age gate, security controls, or moderation systems.
Uploading malware, exploits, phishing pages, or attempting to gain unauthorised access to systems or accounts.
Impersonating another person or entity, including another creator or elGoony staff.
Harassing, threatening, sexually pressuring, or doxxing creators, members, or staff in DMs, communities, comments, or reports.
Using the Service to send unsolicited messages, spam, or unlawful marketing.
Publishing personal data about third parties (real names, addresses, phone numbers, identification documents) without their consent.
Any conduct that is illegal under the laws applicable to you or to us, including applicable EU law.

3. Creator-specific rules

You must hold and retain, for the duration required by applicable national law (and in any event no less than 7 years), written records demonstrating the identity, age, and informed consent of every performer depicted in your content, including yourself, in a form sufficient to satisfy requests from competent authorities.
You must not promise content you will not deliver, mislead members about the nature of subscriptions or unlocks, or operate “bait and switch” tiers.
You must not drive payments off-platform to evade fees, tax or refund obligations.
You must comply with applicable consumer-protection law, including clear pricing and honest descriptions.
Where your content is AI-generated, synthesised, or significantly altered using AI and depicts a real, identifiable person (in part or in whole), you must clearly label it as AI-generated in line with applicable law, including Article 50 of Regulation (EU) 2024/1689 (the “EU AI Act”) once and to the extent applicable. AI-generated sexual or intimate content of an identifiable real person without their verifiable, written consent is prohibited under Section 1.

4. Enforcement ladder

For non-zero-tolerance breaches we will normally apply a proportionate response, taking into account severity, intent, and history:

Warning and/or removal of the offending content.
Temporary feature restriction (e.g. cannot post, cannot purchase, payout hold).
Temporary account suspension.
Permanent account termination and, where appropriate, forfeiture of wallet balance to the extent permitted by law and report to authorities.

Zero-tolerance breaches in Section 1 jump straight to step 4 without prior warning.

5. Reporting

To report content or behaviour that violates this AUP, use our reporting form or email legal@elgoony.com. For suspected CSAM or imminent harm, please also report directly to your national hotline (such as INHOPE members) and to your local law enforcement. For copyright or trademark complaints, see our DMCA / Takedown Notice.

6. Appeals & statement of reasons

In accordance with Articles 17 and 20 of Regulation (EU) 2022/2065 (the EU Digital Services Act, the “DSA”), where we restrict, remove, demote, demonetise, suspend or terminate your content or account we will provide you with a clear statement of reasons covering, as applicable: the legal or policy basis for the action, the factual basis, the geographic scope and duration of the restriction, and the available redress (including this internal appeals procedure and the right to judicial redress before the competent EU court).

You can appeal by replying to the notification email or by writing to support@elgoony.com. We operate an internal complaint-handling system under DSA Article 20 and acknowledge appeals within 5 business days. Appeals for zero-tolerance enforcement actions are reviewed but, where the underlying conduct is verified, the action will stand.

7. Changes

We may update this AUP from time to time. The “Last updated” date above always shows the current version.
